In a country where balance seems to have been lost long ago, and the scales of justice replaced by a rusty crane operated by inertia, the case of Mr. Pop Ionuț-Costin, former Commander of Extrication at Petrobrazi, unfolds as an almost surreal epic. This is a story of how a once courageous citizen, now more like a Sisyphus of bureaucracy, struggles not only against alleged criminals but also against a legal system that, it seems, has forgotten what „delivering justice” truly means. From territorial incompetence to swift dismissals, and now, a monumental defiance of a judicial decision, Mr. Pop’s saga is a faithful mirror of the pathologies within Romanian justice.

Jurisdiction Roulette: An Urban Myth or Just a Flexible Convenience?

It all began with Mr. Pop Ionuț-Costin’s complaint against serious offenses, including blackmail and forgery in private documents, allegedly committed in the Petrobrazi Refinery, Prahova county. Simple, right? According to common sense and, more importantly, Article 41, paragraphs 1(a), 2, and 5 of the Code of Criminal Procedure, territorial jurisdiction belongs to the Prahova Prosecutor’s Office. But not for the Prosecutor’s Office attached to Sector 1 Court in Bucharest! This institution, with a nonchalance worthy of a black comedy, decided it was „competent” because the headquarters of the accused company, FALCK FIRE SERVICES S.R.L., was located in Bucharest. A „flexible” legal logic, as previously highlighted, adaptable, perhaps, to interests or, who knows, to the direction of the wind in its offices. It’s akin to judging a car accident that occurred in Focșani simply because the guilty driver registered their car in Arad. Absurd? Just a detail in this „odyssey of incompetence”!

The „Academic” Dismissal: When Truth Is an Option, Not a Legal Obligation

After two years of „investigations”—a period during which the file most likely sat beneath a pile of less „urgent” papers—the Sector 1 Prosecutor’s Office delivered a Dismissal Order. A single, astonishingly general sentence was deemed sufficient to conclude that the „ordered solution is legal and well-founded in relation to the criminal investigation acts carried out,” without ever specifying what these concrete „acts” entailed. A veritable „riddle-sentence,” where the case prosecutor and, subsequently, the Chief Prosecutor (Mr. Cozma Alin) adopted the solution without any genuine verification.

Why such superficiality? Because, as it turned out, the „investigation” was a farce:

  • Only one witness heard: An economic director from FALCK FIRE SERVICES S.R.L., with no relevant technical attributions. An audition for „ticking a box,” not for uncovering the truth.
  • Key witnesses ignored: Mr. Dumitrescu Adrian, head of the prevention service at Petrobrazi, explicitly named by Mr. Pop, remained an unheard voice.
  • Forgeries overlooked: No graphoscopic expertises were conducted to verify signatures on training forms, where, according to the complainant, he was forced to sign for activities he did not participate in or to perform tasks for which he was not qualified, under threat of losing his job. An accusation of coercion to commit forgery, treated with textbook ignorance!
  • Evidence disregarded: A control act by the DSU Bucharest, which had already confirmed irregularities and ordered measures against the company, was simply ignored.
  • Prejudice, a minor detail: No one investigated whether the Petrobrazi refinery suffered damages from fictitious services, invoiced and collected monthly, but rendered only on paper.

And, the icing on the cake of this incompetence: the complainant himself, Mr. Pop Ionuț-Costin, the initiator of the proceedings, was never summoned or heard to provide additional information. Is justice still done with the one who seeks it, or only in the silence of dusty offices?

A Pyrrhic Victory: Judge Rules, Prosecutors Demand a Year-and-a-Half Break

And just when it seemed that absurdity had reached its peak, the story takes an even more grotesque turn. Mr. Pop Ionuț-Costin did not give up and contested the dismissal order. Surprise! The Sector 1 Court in Bucharest, through its Criminal Conclusion of 09/15/2023, upheld the complaint and sent the case back to the Prosecutor’s Office for further investigation and a lawful resolution! A victory for logic, wouldn’t you say?

Well, no! This „victory” turned out to be a flash in the pan. From the date the file was returned (September 2023) until 04/14/2025—that’s a year and a half!—the Prosecutor’s Office attached to Sector 1 Court did absolutely nothing! Criminal file no. 3654/P/2021, resurrected from the ashes of dismissal, returned to its preferred status: that of a decorative ornament on a shelf, in „inactivity,” under the benevolent gaze of time. Mr. Pop? Not summoned, not heard, not informed. Zero. Absolutely zero action, despite a clear judicial decision. It seems that for some institutions, even court decisions are mere „suggestions.”

Justice on Demand: Should Citizens Have to Beg for Action? A System’s White Night

Desperate, on 04/14/2025, Mr. Pop Ionuț-Costin sent an official address to the Chief Prosecutor, asking, with almost painful naiveté: „What is happening with my case? Has a criminal investigation been initiated against anyone? When do you estimate it will be completed?” A simple plea from a citizen to an institution paid with his money.

The answer?

A deafening echo of silence. More than seven months have passed since that date (as of today, 11/19/2025), and Mr. Pop has received no response! Not even a formality, an excuse, a promise. Nothing. Zero. This blatant disregard for a legitimate request, after the court compelled the Prosecutor’s Office to act, is overwhelming proof of disinterest.

Consequently, on 11/19/2025, Mr. Pop Ionuț-Costin was forced to file a „Contest of the duration of the criminal process” at the Court, in accordance with Article 488^1 of the Code of Criminal Procedure, asking the court to compel the Prosecutor’s Office to do its job within a maximum of two months! This means the citizen has to sue the system because the system refuses to work, even when another court has ordered it to. This is no longer justice, but a tragicomic parody, where victims are forced to pay lawyers to compel authorities to uphold their legal obligations.

A Legislative Farce’s Epilogue: When Bureaucratic Sisyphus Becomes a Pamphlet Hero

The case of Pop Ionuț-Costin is not a simple error but an x-ray of a profound systemic malfunction. It is a story of how a criminal file, initiated for serious offenses such as blackmail and forgery, is transformed into a ping-pong ball between institutions, knowingly ignored, even after a court has dictated the necessity of resuming investigations. It is a stinging slap in the face of any citizen who still believes in the rule of law and the independence of justice.

In this saga of incompetence and disinterest, Mr. Pop Ionuț-Costin, from Petrobrazi, becomes the symbol of the common man’s absurd struggle against a bureaucratic Leviathan that parodies itself. As long as such „formalism”—or rather „nothingness”—prevails over uncovering the truth and respecting the law, the citizen will remain, eternally, a Sisyphus of justice, pushing a stone that always rolls back, to the bitter laughter of a system that seems to have officially declared an indefinite holiday. And, unfortunately, without the hope of paid leave for their efforts. We will return.
